Use of GPS Technology Upheld in Court

Earlier this month a New Jersey court ruled that the use of a GPS tracking device on a vehicle by a private investigator is legal.  The court upheld this ruling saying that using the GPS device is not an invasion of privacy if the technology is used to follow someone when they are in public.  Obtaining photographs and video surveillance of a subject when they are in public has long been upheld as a legal activity and in this case, the court agreed that GPS tracking fits in the same category.

The case in question came out of a domestic situation between a wife and her husband.  After suspecting her husband of being unfaithful, Mrs. Villanova hired a private investigator to follow him.  The investigator suggested that Mrs. Villanova place a GPS tracking device in the glove box of the vehicle, after the investigator’s attempts to follow Mr. Villanova failed.  She placed the device in the glove box and the investigator used the GPS technology to track her husband’s activities.  The court also held that Mrs. Villanova had legal access to place the device in the glove box since she was married to the subject of the investigation.
